THIS IS A CREDIT CARD TRANSACTION. COMPLETION OF THIS TRANSACTION WILL RESULT IN A CHARGE TO YOUR CREDIT CARD. 1. The person completing this transaction affirms that he/she: A. Is the lawful holder of the credit card or has been authorized to use the credit card by the lawful holder. B. Is over the age of 15 or such older age as to be able to enter into a legally binding contract in the state that the person is making the transaction. C. Is not subject to the Child Online Privacy Act. D. Agrees to make payment in accordance with the applicable credit card agreement. 2. The person completing this transaction understands that a breach of paragraph 1 may result in civil or criminal prosecution and agrees to permit the use of all information collected on the website in connection with this transaction by law enforcement agencies, credit card companies, credit card processors, merchant service providers or WMATA and its Regional Partners. 3. This transaction is for the purchase of transit fare value for use on transit systems accepting the SmarTrip® card or the CharmCard® and is not refundable except as provided by the applicable tariff. 4. Only Visa, Mastercard, Discover and American Express branded credit cards are accepted. No debit cards are accepted. No private label cards are accepted. 5. By enrolling in the Auto Reload recurring purchase feature, the Customer agrees that his/her enrollment in Auto Reload acts as authorization to charge his/her credit card in the amount selected on the Auto Reload enrollment form to replenish the fare value on his/her SmarTrip® card or CharmCard® each time the balance on the SmarTrip® card or CharmCard® falls below the amount indicated at the time of setup of Auto Reload for stored value amounts, or to replenish the time-based or ride-based pass according to the schedule indicated at the time of setup of Auto Reload. 6. The Washington Metropolitan Area Transit Authority reserves the right to adjust the balance on a SmarTrip® card or CharmCard® to correct accounting or technical issues or to recover value for which a disputed charge was filed with the applicable credit card company. The Maryland Transit Administration reserves the right to adjust the balance on a SmarTrip® card or CharmCard® card to correct accounting or technical issues or to recover value for which a disputed charge was filed with the applicable credit card company. 7. It is expressly understood and agreed that the customer authorizes WMATA or its agent to access the customer’s credit card and make charges against that card as authorized in this transaction (or if through Auto Reload, as authorized under this Agreement). For CharmCard® purchases, WMATA acts as the processor for the Maryland Transit Administration. The customer expressly understands and agrees that WMATA, its agents, employees, officers, directors or any of the transit properties accepting either SmarTrip® card or CharmCard® shall not be liable for (a) any incidental, indirect, special or consequential damages, including but not limited to, loss of use, revenues, profits or savings, even if any of the foregoing persons and entities knew or should have known of the possibility of such damages, or (b) claims, demands, or actions against the customer by any person, corporation, governmental body, or other entity resulting from the use of the SmarTrip® card or CharmCard®, credit report inquiry, or charging of the customer’s credit card. THE CUSTOMER FURTHER UNDERSTANDS AND AGREES THAT THERE ARE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED OR EXPRESS WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE MADE IN CONNECTION WITH THIS TRANSACTION. The customer agrees to indemnify the persons and/or entities described herein against any loss, damage, or fee resulting from a transaction covered by this Agreement and further agrees to pay all costs, including reasonable attorneys’ fees, incurred by WMATA or any of the persons or entities described in this paragraph, in connection with a transaction contemplated by this Agreement or otherwise necessary to enforce this Agreement. 8. The Customer may cancel his/her enrollment in Auto Reload at any time but will be responsible for any product loads that occur before the receipt of the cancellation request and during the five (5) days immediately following within days after receipt of the cancellation request for cancellation. After the expiration of days after receipt of the cancellation request, Tthe Customer will not be responsible for payment for any product loaded under by the Auto Reload feature six (6) or more days after the receipt of the cancellation request. but WMATA reserves the right to withdraw any product loaded but not paid for. If the product cannot be withdrawn, WMATA reserves the right to hotlist (deactivate) the card. 9. Requests for cancellation of participation in Auto Reload shall be submitted by the customer using the features available in the customer’s SmarTrip Web Account. 10. The Customer is responsible for payment for all products that are loaded to his/her card, including those products ordered under Auto Reload. If the Customer’s credit card is not successfully processed, WMATA will attempt to contact Customer via email to request that Customer provide a valid payment source within 24 hours. If Customer does not provide a valid payment source, then WMATA has the right to remove the product from the SmarTrip® card or CharmCard® that was loaded but not paid for and cancel all Auto Reload orders for the declined billing information. WMATA will attempt to notify Customer that the Auto Reload orders were cancelled. If a product cannot be removed from the SmarTrip® card or CharmCard®, WMATA has the right to hotlist (deactivate) the SmarTrip® card or CharmCard®, WMATA will attempt to notify the customer by email that the card was hotlisted (deactivated) and that the Customer should contact the Regional Customer Service Center to discuss options. 11. WMATA will attempt to contact Customer via email when the credit card is nearing expiration. Should the Customer fail to update his/her billing information 14 days prior to the expiration date of the credit card, all Auto Reload orders will be cancelled. 12. Stored billing information can only be deleted 14 days after active, pending, or remove-pending Auto Reloads have been cancelled to allow WMATA to collect payment for any Auto Reload transactions that may be in process. 13. WMATA may change the terms of this Agreement at any time. Customer is responsible for reading and understanding the terms of this agreement with each one-time credit card purchase, and upon customer action to change billing information associated with Auto Reload. WMATA will not notify customers when the terms of the Agreement have changed. If the Customer is enrolled in Auto Reload, then the use of the SmarTrip® card or CharmCard® after any change in the terms of this Agreement will mean that the Customer has agreed to the change in terms. 14. The provisions of this Agreement are severable, and if any provision or the application to any specific customer is ruled to be unenforceable, the remainder of this Agreement and the application of such provision to other persons or situations shall not be affected. 15. If a SmarTrip® card or CharmCard® is lost or stolen, it is the obligation of the customer to promptly report the loss or theft via customer’s SmarTrip® card or CharmCard® web account at www.wmata.com, the telephone number listed on the card [(1-888-762-7874] or e-mail at smartrip@wmata.com or mtacharmcard@mtamaryland.com. Any remaining fare value on the lost or stolen card, at the time of reporting the card as lost or stolen using the methods described above, will be transferred to a new card, minus the replacement fee, only if the lost or stolen card was registered and covered by the balance protection policies. The loss or theft of a SmarTrip® card or CharmCard® is not grounds for invalidating a credit card transaction and the customer agrees not to file for a disputed charge with his/her credit card company. 16. Damaged SmarTrip® cards or CharmCard®s may be returned by contacting the Regional Customer Service Center using the website, phone number or email address in Item # 15 for replacement and will have the value remaining on the card according to the records on file with the issuing transit property transferred to the replacement card, minus the replacement fee. The need for replacement of a SmarTrip® card or CharmCard® does not invalidate any credit card transaction for the purchase of fare value to be placed on the SmarTrip® card or CharmCard®. 17. All disputes between a customer and the issuing transit property shall be governed by the law of the state in which the headquarters for the transit property is located. WMATA将在信用卡逾期之前通过电子邮件与客户联系。如果客户未能在信用卡逾期前14天内更新他/她的记帐信息，所有自动充值的产品将被取消。 12. 只有在有效、待确认或待去除的自动充值产品被取消14天后才能删除系统储存的记帐信息，以便WMATA有时间索回可能正在经办的任何自动充值的交易费用。 13. WMATA可在任何时候更改本协议条款。客户有责任在每次使用信用卡付款时以及在客户更改自动充值的记帐信息时阅读并理解本协议条款。WMATA不会在本协议更改后通知客户。如果客户选择参加自动充值计划，在本协议条款更改后客户继续使用SmarTrip®卡或CharmCard®卡则意味着客户已同意更改后的条款。 14. 本协议的条款可分割，而且如果某条款或某具体客户的适用被裁定为不可执行，本协议的其余条款或其适用性对其他人或在其他情形下不应受到影响。 15. 如果 SmarTrip®卡或CharmCard®卡遗失或被盗，客户有义务通过其SmarTrip®卡或CharmCard®卡在www.wmata.com的网上帐户、交通卡上所列的电话号码[(1-888-762-7874]或smartrip@wmata.com或mtacharmcard@mtamaryland.com所列的电子邮件地址及时报告遗失或被盗。只要遗失或被盗的交通卡已经登记并符合余额保护的政策，遗失或被盗交通卡内的余额将按上述方法报告遗失或被盗的时间为准全部转入新发的交通卡内，扣除换卡手续费。遗失或被盗SmarTrip®卡或CharmCard®卡不能作为信用卡交易无效的理由而且客户同意不向他/她的信用卡公司提出收费有争议的请求。 16. 如果SmarTrip®卡或CharmCard®卡有损坏情况，可通过第15款所列的网址、电话号码或电子邮件地址与地区客户服务中心联系，退还旧卡换新卡，而且卡内的余额将根据签发交通卡的客运公司之记录转入新卡，扣除换卡手续费。不能因为需要更换SmarTrip®卡或CharmCard®卡而使购买或充值SmarTrip®卡或CharmCard®卡的任何信用卡交易无效。 17. 客户与签发交通卡的客运公司之间的任何争议应按照客运公司总部所在州的法律解决。所有的法律诉讼只能提交给客运公司总部所在的州法庭和地处该州的联邦法庭。 CECI EST UNE TRANSACTION PAR CARTE DE CRÉDIT. S'engage à effectuer le paiement conformément aux dispositions de l'accord de carte de crédit applicable. 2. La personne qui effectue cette transaction comprend qu'une violation du paragraphe 1 peut entraîner des poursuites civiles ou pénales et s'engage à permettre l'utilisation de toutes les informations collectées sur le site web dans le cadre de cette transaction par les services répressifs, les sociétés de cartes de crédit, les processeurs de cartes de crédit, les fournisseurs de services marchands ou la WMATA et ses partenaires régionaux. 3. En s'inscrivant à la fonction Auto Reload pour achats récurrents, le client accepte que son inscription à l'Auto Reload agisse comme une autorisation de facturer sa carte de crédit au montant sélectionné sur le formulaire d'inscription d'Auto Reload pour reconstituer la valeur du titre de transport sur sa carte SmarTrip® ou sa CharmCard® à chaque fois que le solde de la carte SmarTrip® ou CharmCard® tombe en dessous du montant indiqué au moment de la mise en place d'Auto Reload pour les montants de valeur stockée, ou pour reconstituer l'abonnement basé sur le temps ou la distance en fonction du programme indiqué au moment de la mise en place d'Auto Reload. 6. La Washington Metropolitan Area Transit Authority se réserve le droit d'ajuster le solde sur une carte SmarTrip® ou CharmCard® pour corriger des problèmes comptables ou techniques ou pour récupérer la valeur d'un montant objet d'un litige déposé auprès de la société de carte de crédit applicable. Il est expressément entendu et convenu que le client autorise la WMATA ou son agent à accéder à la carte de crédit du client et de porter des charges contre cette carte tel qu'autorisé dans cette transaction (ou si par le biais d'Auto Reload, tel qu'autorisé en vertu du présent Accord). Pour les achats de CharmCard®, la WMATA agit comme processeur pour le compte de la Maryland Transit Administration. Le client comprend et accepte expressément que la WMATA, ses agents, employés, dirigeants, administrateurs ou l'une des entreprises de transport qui acceptent soit une carte SmarTrip® ou CharmCard® ne doit pas être tenue responsable de (a) tout dommage accessoire, indirect, particulier ou consécutif, y compris, mais sans s'y limiter, la perte d'utilisation, de revenus, de bénéfices ou d'épargnes, même si l'une des personnes et entités ci-dessus connaissait ou aurait dû connaître la possibilité de tels dommages, ou (b) les réclamations, demandes ou actions contre le client par toute personne, société, entité gouvernementale, ou toute autre entité résultant de l'utilisation de la carte SmarTrip® ou de la CharmCard®, d'une enquête sur un rapport de crédit, ou d'une charge portée à la carte de crédit du client. PAR AILLEURS, LE CLIENT COMPREND ET ACCEPTE QU'IL N'Y A AUCUNE REPRÉSENTATION OU GARANTIE, EXPRESSE OU IMPLICITE, Y COMPRIS, SANS LIMITATION, AUCUNE GARANTIE EXPRESSE OU IMPLICITE DE QUALITÉ MARCHANDE ET D'ADÉQUATION À UN USAGE PARTICULIER FAIT DANS LE CADRE DE CETTE TRANSACTION. Le client s'engage à indemniser les personnes et / ou entités décrites ci-après contre toute perte, dommage ou frais résultant d'une transaction couverte par le présent Accord et s'engage en outre à payer tous les frais, y compris les honoraires raisonnables d'avocats, engagés par la WMATA ou l'une quelconque des personnes ou entités décrites dans ce paragraphe, dans le cadre d'une transaction visée dans le présent Accord ou autrement nécessaire pour l'exécution de cet Accord. 8. Le client peut annuler à tout moment son inscription à l'Auto Reload mais sera responsable de toutes les charges de produits qui auraient lieu avant réception de la demande d'annulation et au cours des cinq (5) jours suivant immédiatement la réception de la demande d'annulation. Le client ne sera pas responsable du paiement d'un produit chargé dans le cadre de la fonction d'Auto Reload six (6) jours ou plus après la réception de la demande d'annulation. La WMATA se réserve le droit de retirer tout produit chargé, mais non payé. Si le produit ne peut pas être retiré, la WMATA se réserve le droit de mettre la carte sur une liste rouge (la désactiver). 9. Les demandes d'annulation de participation à l'Auto Reload doivent être soumises par le client en utilisant les fonctions disponibles sur le compte Web du SmarTrip® du client. 10. Le client est responsable du paiement de tous les produits qui sont chargés sur sa carte, y compris les produits commandés par le biais d'Auto Reload. Si la carte de crédit du client n'est pas traitée avec succès, la WMATA tentera de contacter le client par courrier électronique pour demander au client de fournir une source de paiement valide dans les 24 heures. Si le client ne fournit pas une source de paiement valide, la WMATA aura alors le droit de retirer de la carte SmarTrip® ou de la CharmCard® le produit qui a été chargé mais non payé et d'annuler toutes les commandes d'Auto Reload en raison du manque des informations de facturation. La WMATA tentera d'aviser le client que les commandes d'Auto Reload ont été annulées. Si un produit ne peut pas être retiré de la carte SmarTrip® ou de la CharmCard®, la WMATA a le droit de mettre la carte SmarTrip® ou la CharmCard® sur une liste rouge (la désactiver). La WMATA tentera d'aviser le client par courrier électronique que la carte a été mise sur liste rouge (désactivée) et que le client doit contacter le Centre régional de service à la clientèle pour discuter de ses options. 11. La WMATA tentera de contacter le client par courrier électronique lorsque la carte de crédit est en voie d'expiration. Si le client omet de mettre à jour ses données de facturation dans les 14 jours précédant la date d'expiration de la carte de crédit, toutes les commandes d'Auto Reload seront annulées. 12. Les informations de facturation stockées ne peuvent être supprimées que dans les 14 jours après que des charges d'Auto Reload actives, en attente, ou en attente d'annulation aient été annulées afin de permettre à la WMATA de percevoir le paiement pour toutes les transactions d'Auto Reload qui pourraient être en cours. 13. La WMATA peut modifier les termes du présent Accord à tout moment. La WMATA n'avisera pas les clients lorsque les termes de l'Accord ont changé. Si le client est inscrit à l'Auto Reload, l'utilisation de la carte SmarTrip® ou de la CharmCard® après tout changement dans les termes du présent Accord signifiera alors que le client a accepté ces changements de termes. 14. Les dispositions du présent Accord sont dissociables, et si une disposition ou son application à un client donné est jugée inapplicable, le reste de cet Accord et l'application de cette disposition à d'autres personnes ou situations ne seront pas affectés. 15. Si une carte SmarTrip® ou une CharmCard® est perdue ou volée, le client a l'obligation de signaler rapidement la perte ou le vol par l'intermédiaire du compte web de sa SmarTrip® ou CharmCard® sur le site www.wmata.com, au numéro de téléphone indiqué sur la carte [1-888-762-7874] ou par courrier électronique à smartrip@wmata.com ou mtacharmcard@mtamaryland.com.Toute valeur du titre de transport restant sur la carte perdue ou volée, au moment de la déclaration de perte ou de vol de la carte en utilisant les méthodes décrites ci-dessus, sera transférée à une nouvelle carte, moins les frais de remplacement, uniquement si la carte perdue ou volée a été enregistrée et est couverte par le régime de protection de solde. La perte ou le vol d'une carte SmarTrip® ou d'une CharmCard® n'est pas un motif d'annulation d'une transaction de carte de crédit et le client s'engage à ne pas déposer de réclamation pour charge litigieuse auprès de sa société de carte de crédit. 16. Les cartes SmarTrip® ou CharmCard® endommagées peuvent être retournées en contactant le Centre régional de service à la clientèle par le biais du site web, du numéro de téléphone, ou de l'adresse de courrier électronique figurant au paragraphe 15 pour demander un remplacement et elles auront la valeur restant sur la carte, selon les dossiers en possession de l'organisme de transport qui les ont émises, transférée à la carte de remplacement, moins les frais de remplacement. Washington Metropolitan Area Transit Authority(워싱턴 광역 교통 본부)는 회계나 기술 관련 사안의 시정을 위하여 SmarTrip® 카드 또는 CharmCard®의 잔액을 조절하거나 해당 크레딧 카드 회사에 대해 분쟁 대상의 비용이 신청된 금액을 회수하는 권리를 보유합니다. Maryland Transit Administration(메릴랜드 교통 본부)는 회계나 기술 관련 사안의 시정을 위하여 SmarTrip® 카드 또는 CharmCard® 잔액을 조절하거나 해당 크레딧 카드 회사에 대해 분쟁 대상의 비용이 신청된 금액을 회수하는 권리를 보유합니다. 7. 고객은 WMATA 또는 그 대리인이 고객의 크레딧 카드에 접속하여 본 거래에서 승인된 내용에 따라(또는 자동 리로드의 경우라면 본 계약서에서 승인된 내용에 따라) 그 카드에 비용을 부과하는 것을 명백히 이해하고 동의합니다. KHÁCH HÀNG CÒN HIỂU VÀ ĐỒNG Ý RẰNG KHÔNG CÓ LỜI NÓI HOẶC BẢO ĐẢM NÀO--RÕ RÀNG HAY NGỤ Ý, KỂ CẢ, NHƯNG KHÔNG HẠN CHẾ, BẤT KỲ BẢO ĐẢM HOẶC RÕ RÀNG HAY NGỤ Ý NÀO VỀ CHUYỆN THẺ NÀY CÓ THỂ DÙNG CHO MUA BÁN, HOẶC DÙNG CHO MỘT MỤC ĐÍCH NÀO KHÁC--ĐƯỢC ĐƯA RA KHI CÓ VỤ GIAO DỊCH NÀY. Khách hàng đồng ý bồi thường cho các cá nhân và/hoặc các tổ chức được mô tả trong tài liệu này khi có bất kỳ tổn thất, thiệt hại, lệ phí từ một vụ giao dịch được đề cập trong thỏa thuận này và cũng đồng ý trả tất cả các chi phí, kể cả thù lao luật sư hợp lý, phát sinh bởi WMATA hoặc bất kỳ các cá nhân hoặc tổ chức nào được mô tả trong đoạn này, có liên quan đến một vụ giao dịch được nói tới trong thỏa thuận này, hoặc nếu không thì cũng cần thiết để thực thi thỏa thuận này. 8. Khách hàng có thể hủy bỏ việc ghi danh của mình cho Auto Reload bất cứ lúc nào nhưng sẽ chịu trách nhiệm cho bất kỳ vụ di chuyển nào xảy ra trước khi yêu cầu hủy bỏ được tiếp nhận vá trong vòng năm (5) ngày kế tiếp ngày yêu cầu hủy bỏ. Khách hàng sẽ không chịu trách nhiệm thanh toán cho bất kỳ vụ di chuyển nào dựa theo chương trình Auto Reload kể từ sáu (6) ngày sau khi nhận yêu cầu hủy bỏ. WMATA có quyền tính tiền cho những vụ di chuyển nào chưa được trả tiền. Nếu không tính tiền được, WMATA dành quyền làm mất hiệu lực (làm ngưng hoạt động) của thẻ. 9. Yêu cầu huỷ bỏ tham gia Auto Reload được khách hàng thực hiện bằng cách sử dụng các tính năng trong tài khoản SmarTrip của khách hàng có sẵn trên mạng. 10. Khách hàng có trách nhiệm thanh toán cho tất cả các sản phẩm được nạp vào thẻ của khách, bao gồm những sản phẩm đã đặt theo Auto Reload. Nếu thẻ tín dụng của khách hàng không được xử lý tốt, WMATA sẽ cố gắng liên lạc với khách bằng email để yêu cầu khách cung cấp một cách thanh toán hợp lệ trong vòng 24 giờ. Nếu khách hàng không cung cấp một cách thanh toán hợp lệ, WMATA có quyền loại bỏ sản phẩm trong thẻ SmarTrip® hoặc CharmCard® đã được nạp nhưng không được trả tiền, và hủy bỏ tất cả các lệnh đặt hàng Auto Reload cho các thông tin thanh toán bị từ chối. WMATA sẽ cố gắng thông báo cho khách hàng rằng các lệnh đặt hàng Auto Reload đã bị hủy bỏ. Nếu một sản phẩm không thể được loại bỏ từ thẻ SmarTrip® hoặc CharmCard®, WMATA có quyền vô hiệu hóa (ngừng hoạt động) thẻ SmarTrip® hoặc CharmCard®, WMATA sẽ cố gắng thông báo cho khách hàng bằng email rằng thẻ đã bị vô hiệu hóa (ngừng hoạt động,) trong trường hợp này khách hàng nên liên hệ với Trung tâm Phục vụ Khách hàng Khu vực (Regional Customer Service Center) để thảo luận các giải pháp chọn lựa. 11. WMATA sẽ cố gắng liên hệ với khách hàng bằng email khi thẻ tín dụng gần hết hạn sử dụng. Nếu khách hàng không cập nhật thông tin thanh toán trong 14 ngày trước khi thẻ tín dụng hết hạn, tất cả các lệnh đặt hàng Auto Reload sẽ bị hủy bỏ. 12. Thông tin thanh toán đã lưu trữ chỉ có thể được xóa 14 ngày sau khi hoạt động, chờ giải quyết, hoặc chờ ngưng Auto Reload để cho phép WMATA thu tiền cho bất kỳ giao dịch bằng Auto Reload nào có thể xảy ra. 13. WMATA có thể thay đổi các điều khoản của thỏa thuận này bất cứ lúc nào. Khách hàng có trách nhiệm đọc và hiểu các điều khoản của thỏa thuận này mỗi lần mua với thẻ tín dụng, và mỗi khi khách hàng có hành động để thay đổi thông tin thanh toán liên quan đến Auto Reload. WMATA sẽ không thông báo cho khách hàng khi đã thay đổi các điều khoản của thỏa thuận. Nếu khách hàng tham gia Auto Reload, thì sử dụng thẻ SmarTrip® hoặc CharmCard® sau khi có bất kỳ thay đổi nào trong các điều khoản của thỏa thuận này sẽ có nghĩa là khách hàng đã đồng ý sự thay đổi của các điều khoản. 14. Các quy định của thỏa thuận này có thể tách rời, và nếu bất kỳ điều khoản hoặc áp dụng cho bất kỳ khách hàng cụ thể được xét là không thể thực thi, phần còn lại của thỏa thuận này và việc áp dụng quy định đó cho người khác hoặc các tình huống khác sẽ không bị ảnh hưởng. 15. Nếu thẻ SmarTrip® hoặc CharmCard® bị mất hoặc bị đánh cắp, khách hàng có nghĩa vụ báo cáo kịp thời sự mất mát hoặc trộm cắp thông qua tài khoản thẻ SmarTrip® hoặc CharmCard® của khách trên mạng, tại www.wmata.com, số điện thoại có ghi trên thẻ [(1-888-762-7874)] hoặc gửi e-mail cho smartrip@wmata.com hoặc mtacharmcard@mtamaryland.com. Bất kỳ giá trị vé còn lại trên thẻ bị mất hoặc bị đánh cắp, tại thời điểm báo cáo thẻ bị mất hoặc bị đánh cắp bằng cách sử dụng các phương pháp nói trên, sẽ được mang sang cho thẻ mới, trừ đi khoản phí thay thế, với điều kiện thẻ bị mất hoặc bị đánh cắp đã được đăng ký và bảo hiểm bởi các chính sách bảo vệ số tiền còn dư. Chúng tôi không lấy l‎ý do mất hoặc bị đánh cắp thẻ SmarTrip® hoặc CharmCard® để vô hiệu hóa việc giao dịch bằng thẻ tín dụng và khách hàng đồng ý không yêu cầu công ty phát hành thẻ tín dụng của mình khoan thanh toán vụ giao dịch vì đang có tranh chấp. 16. Thẻ SmarTrip® hoặc CharmCard® bị hư hỏng có thể được trả lại bằng cách liên lạc với Trung tâm Phục vụ Khách hàng Khu vực, sử dụng trang mạng, số điện thoại, hoặc địa chỉ email trong đoạn 15 để có thẻ thay thế, và số tiền còn lại sẽ được chuyển vào thẻ thay thế, dựa trên hồ sơ mà cơ quan vận chuyển đang có, trừ đi khoản phí thay thế. Nhu cầu thay thế thẻ SmarTrip® hoặc CharmCard® không làm mất hiệu lực bất kỳ giao dịch thẻ bằng tín dụng nào muốn mua thêm vé để đưa vào thẻ SmarTrip® hoặc CharmCard®. 17. Tất cả các tranh chấp giữa khách hàng và cơ quan phát hành thẻ vận chuyển sẽ được chi phối bởi pháp luật của tiểu bang mà cơ quan phát hành thẻ vận chuyển đặt trụ sở chính. Tất cả các hành vi pháp lý chỉ có thể đưa ra trước các tòa án tiểu bang và liên bang nằm trong tiểu bang mà cơ quan phát hành thẻ vận chuyển có trụ sở chính.
